Refund and Cancellation Policy

Presume Overseas Education (OPC) Pvt. Ltd. (“Company”), based in Indore, Madhya Pradesh, is committed to maintaining the confidentiality and privacy of its clients. We take reasonable steps to protect personal information collected by the Company from misuse, loss, unauthorized access, modification, or disclosure. The Company may use and disclose clients’ personal information for purposes including, but not limited to, conducting our business, providing and marketing our services, communicating with clients, complying with legal obligations, and managing and improving our services.

Refund Policy

1. No Refund for Back-out: The Company has a strict policy against issuing refunds for Back-out candidates in between the process.

2. Refund Eligibility: Refunds are applicable only if the full service fee is paid in advance, without any outstanding balance. If the fee is not paid in full, clients are not eligible for a refund, even if they meet other refund criteria.

3. Immigration Decisions: Immigration decisions are sometimes made based on anticipated changes in policy. Clients may be registered before final qualifications are announced to meet cap requirements. If a client’s profile becomes ineligible after such announcements, they may transfer to other available opportunities.

4. Zero Tolerance for Chargebacks: Any client who disputes a valid credit card payment will be permanently blacklisted and barred from using our services. Unpaid fees will be sent to collections and reported to Credit Reporting Agencies.

5. Refund on Consultation Fee Only: Refunds will only be calculated on the consultation fee. Taxes and Process charges are non-refundable.

6. Rejection by Immigration Authorities: In case of rejection by Immigration Authorities, the Company will refund the applicable amount as stated in the service agreement. The refund will be processed within 15-30 working days after the client submits a completed Online Refund Claim Form along with the rejection letter from the authorities.

7. No Responsibility for Third-Party Delays: The Company is not responsible for delays caused by third-party services, and no refund of service charges will be issued for such delays.

8. Non-Refundable Fees: The Company is not responsible for refunds of any fees paid to Assessing Bodies, Immigration Authorities, Embassies, or Consulates in the event of rejection or non-acceptance at any stage. These fees are separate from our service charges.

9. Payment Methods: Clients paying via online card services or net banking agree not to withdraw or chargeback the payment without notifying the Company, except as allowed under applicable law.

10. Non-Refundable Services: Service charges paid to the Company are non-refundable once the services have commenced, or any part of the process has begun, regardless of any change in the client’s personal circumstances.

11. Disclosure Requirements: Clients are required to provide all necessary documents and information at the time of registration to enable the Company to proceed with their application. Failure to do so may result in forfeiture of the refund.

12. Participation in Interviews: Clients must attend all interviews and comply with any requirements set by the concerned authorities at their own cost. Failure to do so will void any refund claims.

13. No Refund for Certain Rejections: No refund will be issued if the application is rejected for reasons including, but not limited to, fake documents, failure to attend interviews, failure of medicals, non-compliance with Embassy or Consulate requirements, insufficient funds, or prior immigration law
violations.

14. Service Charges: The service charges are based on the Company’s standards and are not subject to market comparisons. Any claims of the charges being excessive after registration will not be entertained.

15. Disclosure of Criminal Records: Clients must disclose any criminal records or past convictions. Failure to do so will result in the forfeiture of any refund.

Force Majeure

The Company shall not be liable for any failure or delay in the performance of its obligations due to
events beyond its control, including but not limited to natural disasters, acts of war, terrorism, or any
other unforeseen circumstances

 

Governing Law and Jurisdiction

This policy is governed by the laws of the Government of India and the State of Madhya Pradesh. Any disputes will be subject to the exclusive jurisdiction of the courts in Indore, Madhya Pradesh.
